Apply OCI from Indian Embassy Jakarta

OVERSEAS CITIZENSHIP OF INDIA (OCI) CARD:
Eligibility Criteria:
A foreign national, who was eligible to become a citizen of India on 26.01.1950 or was a citizen of India on or at any time after 26.01.1950 or belonged to a territory that became part of India after 15.08.1947 and his/her children and grandchildren, is eligible for registration as an Overseas Citizen of India (OCI). Minor children of such person are also eligible for OCI. However, if the applicant had ever been a citizen of Pakistan or Bangladesh, he/she will not be eligible for OCI.
Benefits to OCI:
  • Multiple-entry, multi-purpose life-long visa to visit India;
  • Exemption from reporting to Police authorities for any length of stay in India;
  • Parity with NRIs in financial, economic and educational fields except in the acquisition of agricultural or plantation properties;
  • A person registered as OCI is eligible to apply for grant of Indian citizenship under section 5(1) (g) of the Citizenship Act, 1955 if he/she is registered as OCI for five years and has been residing in India for one year out of the five years before making the application;
  • Any other benefits to OCI which may be notified by the Ministry of Overseas Indian Affairs (MOIA) under Section 7B(1) of the Citizenship Act, 1955.
Benefits to which OCI is not entitled: 
  • The OCI card holder is not entitled to vote;
  • Cannot be a member of Legislative Assembly or Legislative Council or Parliament;
  • He/she cannot hold constitutional posts such as President, Vice President, Judge of Supreme Court or High Court etc;
  • Cannot normally hold employment in the Government.
Application Form and Procedure:
Detailed instructions are given at www.mha.nic.in/ociwhich should be carefully read before applying. For new registration please click on “online registration”.
Completed applications along with all the enclosures can be submitted in person at the Embassy counter, or someone can be authorized to submit your application.
After grant of OCI registration, a Registration Certificate in the form of a booklet will be issued and a multiple entry, multi-purpose life-long OCI 'U' visa sticker will be pasted on the foreign passport of the applicant.
Vide circular No. 26011/06/2015-OCI dated 29th January, 2015 of Ministry of Home Affairs, Government of India, all immigration authorities in India will not insist on production of the foreign passport containing the 'U' Visa Sticker in the case of OCI Cardholders while they enter/exit India and the immigration clearance will be granted based on production of the 'OCI CARD ONLY'.
Documents required at the time of submission at the Embassy:
  1. Print-out of the on-line application form.
  2. Current passport Original and copy of first page and page with address. (After verification original passport will be returned to applicant at the same time).
  3. Two Photographs (51mmx51mm with 80% coverage of face) detailed specification can be seen at useful links at http://passport.gov.in/oci
  4. Surrender Certificate:  Indian passports must be surrendered by foreign nationals at the Embassy to obtain the surrender certificate which may be submitted in original along with a copy of the same while applying for the OCI card.  After verifying the facts the original surrender certificate will be returned to the applicants. 
  5. For a person born abroad and applying on the basis of their parents/grand parents’ Indian origin - A copy of birth certificate/marriage certificate along with the Indian origin proof of their parents/grandparents must be furnished by the applicants to prove their link with them.
  6. Non-Indonesian passport holder should give residential Permit (KITAS) of Indonesia and such cases require more processing time.

This document is issued primarily with the objective of ensuring the applicant's return to India in an emergency. Applicants should fill in online application form as prescribed for the issue of a new passport and come for a personal interview

Step by Step Mengurus Dokumen Pernikahan dengan WN India di Indonesia secara Islam.


Berikut adalah pengalaman pribadiku ketika mengurus dokumen pernikahan dengan suamiku yang berkewarganegaraan India. Berdasarkan pengalaman pribadi dan teman-teman yang lain, KUNCI untuk mengurus dokumen pernikahan adalah seperti ini:

·      Bila pernikahan di lakukan di Indonesia, maka dokumen dari Pihak WNA harus disiapkan terlebih dahulu. Dan sebaliknya.

Jadi suami terlebih dahulu menyiapkan dokumen-dokumen sebagai berikut:

1. Fotokopi paspor dan asli nya

2. Fotokopi visa (waktu itu suamiku pakai VOA. Jadi ini di peroleh saat dia datang ke Indonesia. Dibandara soeta Jakarta waktu itu)

3. Affidavit atau surat Pernyataan status pernikahan (single/pernah menikah) yang dibuat oleh orang tua suamiku dan ditandatangani oleh mereka yang menyatakan bahwa suami belum pernah menikah dan mereka tidak keberatan dengan pernikahan kedua belah pihak. Affidavit ini di buat oleh notaris atau pengacara di India sesuai domisili diatas kertas bermaterai. Dan dilegalisir oleh pejabat pengadilan setempat. Biasanya notaris yang mengurus legalisirnya. Kita terima jadi aja. Contoh terlampir.

4. Fotokopi akta kelahiran. Aslinya dibawa buat jaga-jaga kalau diperlukan.

5. Pas Photo ukuran 2x3 dan 4x4 latar belakang putih. Masing-masing 12 lembar. Lebih baik lebih dari pada kurang.


Setelah itu aku mulai menyiapkan dokumen-dokumenku sendiri, antara lain:

1. Fotokopi KK dan KTP di lealisir untuk mengurus NOC di Kedutaan India

2. Pas Photo ukuran 2x3 dan 4x4 latar belakang putih. Masing-masing 12 lembar. Lebih baik lebih dari pada kurang.

3. Membuat surat keterangan status pernikahan di kelurahan (belum menikah/duda/janda) kemudian di fotokopi dan dilegalisir Kepala Kelurahan. Ini untuk mengurus No Objection Certificate (NOC) di kedutaan India.


Kemudian aku mendatangi petugas pengurus pernikahan di kelurahanku untuk mendaftarkan rencana pernikahan kami. Petugas meminta dokumen-dokumen sebagai persyaratan menikah sebagai berikut:

Dari pikah WNI:
1. Fotokopi KTP dan KK

2. Fotokopi surat keterangan masih single atau belum pernah menikah. (Kalau sebelumnya pernah menikah, surat cerai atau surat kematian pasangan sebelumnya harus dilampirkan)

3. Pas photo ukuran 2x3 latar belakang putih 6 lembar

4. Menandatangani formulir N1-N4 dan N7. Tidak perlu pusing mengisinya karena petugas yang mengisinya. Kita tinggal tanda tangan. Contoh formulir terlampir.

Apa itu N1-N7?
N1 : Surat Keterangan Untuk Nikah
N2: Surat Keterangan Asal-usul
N3: Surat Persetujuan mempelai
N4: Surat Keterangan Tentang Orang Tua
N5: Surat Ijin Orang Tua. Ini hanya bila calon mempelai berumur dibawah 21 tahun tapi diatas 16 tahun/19 tahun.
N6: Surat Keterangan Kematian Suami/Istri. Ini hanya apabila sebelumnya pernah menikah dan pasangan sebelumnya meninggal dunia.
N7: Surat Pemberitahuan Kehendak Nikah

Dari pihak WNA :
1. Fotokopi paspor dan visa.
2. Fotokopi akta kelahiran
3. NOC asli. (jangan lupa fotokopi an nya disimpan untuk dokumen pribadi)
4. Pas photo ukuran 2x3 latar belakang putih 6 lembar
5. Fotokopi affidavit atau surat pernyataan status single atau belum pernah menikah.


Karena waktu itu suami belum datang ke Indonesia, maka fotokopi visa dan NOC kami serahkan menyusul. Sedangkan syarat lainnya sudah dikirim suami via email. Scan berwarna.


Petugas mendatangi rumah kami untuk melakukan survey. Bertemu dengan orang tuaku. Kebetulan tempat dimana kami akan menikah berbeda dengan data identitas, maka petugas harus mengurus surat numpang nikah di kelurahan tempat pernikahan kami akan dilangsungkan. Semua petugas yang mengurus. Termasuk ke KUA. Jadi aku tidak mengurus apapun ke KUA. Cukup petugas pengurus pernikahan di kelurahan yang mengurus semuanya. Mungkin ditempat lain tidak akan sama.


Setelah itu aku ke kedutaan India di Jakarta mengurus  NOC. Pihak kedutaan mengatakan dokumen sudah lengkap tapi calon harus datang juga untuk menandatangani formulir yang disediakan oleh kedutaan untuk proses pengajuan NOC dari kedutaan.

Akhirnya aku kembali dan menunggu kedatangan suami. Beberapa hari berikutnya suami datang dan kita ke Kedutaan India di Jakarta untuk mengajukan No Objection Certificate (NOC) for Marriage. Syarat-syarat yang kami siapkan sebagai berikut:

1. Fotokopi passport pihak WNA dengan menunjukkan aslinya

2. Fotokopi KTP WNI yang dilegalisir pihak kelurahan setempat sesuai domisili

3. Fotokopi KK WNI yang dilegalisir pihak kelurhan setempat sesuai domisili

4. Affidavit atau surat pernyataan belum menikah oleh orang tua WNA yang ditandatangani notaris di India dan dilegalisir oleh pengadilan setempat.

5. Pas photo 4x4 latar belakang putih untuk pihak WNI dan WNA

6. Surat pernyataan masih single atau belum pernah menikah dari pihak WNI yang dilegalisir di kelurahan setempat sesuai domisili.

7. Menandatangani formulir NOC yang disediakan oleh pihak kedutaan

8. Membayar biaya Rp 256.000 (sekarang Rp 318.000,- Updated Maret 2015)

Proses pengajuan NOC ketika itu kami datang jumat pagi. Harusnya NOC bisa diambil selasa sore tetapi berhubung minggu kami menikah maka kami melakukan negosiasi dengan petugas di kedutaan. Alhamdulillah di kabulkan. Jadi NOC bisa kami ambil Jumat sore. Contoh NOC terlampir.

Sabtu pagi kami berangkat ke kota dimana pernikahan dilangsungkan untuk mengurus Perjanjian Pra Nikah (Prenuptial Agreement). Penjelasan soal Perjanjian Pra Nikah (Prenuptial Agreement) bisa dibaca DISINI. Setelah selesai, kami bertemu petugas pengurus pernikahan dengan menyerahkan fotokopi visa, NOC dari kedutaan India dan fotokopi surat perjanjian pra nikah. Mengapa fotokopi surat perjanjian pra nikah kami lampirkan? Agar perjanjian pra nikah tersebut terdaftar di KUA (Halaman terakhir buku Nikah).  Contoh Terlampir.



Minggu nya kami menikah dan senin kami menerima buku nikah kami. Selanjutnya kami kembali ke Jakarta untuk mengurus legalisasi buku nikah kami di Kementrian Hukum dan HAM, Kementrian Luar Negeri dan Kedutaan India di jakarta. Bisa di baca di postingan ProsesLegalisasi Buku Nikah.
