Apply OCI from Indian Embassy Jakarta

OVERSEAS CITIZENSHIP OF INDIA (OCI) CARD:
Eligibility Criteria:
A foreign national, who was eligible to become a citizen of India on 26.01.1950 or was a citizen of India on or at any time after 26.01.1950 or belonged to a territory that became part of India after 15.08.1947 and his/her children and grandchildren, is eligible for registration as an Overseas Citizen of India (OCI). Minor children of such person are also eligible for OCI. However, if the applicant had ever been a citizen of Pakistan or Bangladesh, he/she will not be eligible for OCI.
Benefits to OCI:
  • Multiple-entry, multi-purpose life-long visa to visit India;
  • Exemption from reporting to Police authorities for any length of stay in India;
  • Parity with NRIs in financial, economic and educational fields except in the acquisition of agricultural or plantation properties;
  • A person registered as OCI is eligible to apply for grant of Indian citizenship under section 5(1) (g) of the Citizenship Act, 1955 if he/she is registered as OCI for five years and has been residing in India for one year out of the five years before making the application;
  • Any other benefits to OCI which may be notified by the Ministry of Overseas Indian Affairs (MOIA) under Section 7B(1) of the Citizenship Act, 1955.
Benefits to which OCI is not entitled: 
  • The OCI card holder is not entitled to vote;
  • Cannot be a member of Legislative Assembly or Legislative Council or Parliament;
  • He/she cannot hold constitutional posts such as President, Vice President, Judge of Supreme Court or High Court etc;
  • Cannot normally hold employment in the Government.
Application Form and Procedure:
Detailed instructions are given at www.mha.nic.in/ociwhich should be carefully read before applying. For new registration please click on “online registration”.
Completed applications along with all the enclosures can be submitted in person at the Embassy counter, or someone can be authorized to submit your application.
After grant of OCI registration, a Registration Certificate in the form of a booklet will be issued and a multiple entry, multi-purpose life-long OCI 'U' visa sticker will be pasted on the foreign passport of the applicant.
Vide circular No. 26011/06/2015-OCI dated 29th January, 2015 of Ministry of Home Affairs, Government of India, all immigration authorities in India will not insist on production of the foreign passport containing the 'U' Visa Sticker in the case of OCI Cardholders while they enter/exit India and the immigration clearance will be granted based on production of the 'OCI CARD ONLY'.
Documents required at the time of submission at the Embassy:
  1. Print-out of the on-line application form.
  2. Current passport Original and copy of first page and page with address. (After verification original passport will be returned to applicant at the same time).
  3. Two Photographs (51mmx51mm with 80% coverage of face) detailed specification can be seen at useful links at http://passport.gov.in/oci
  4. Surrender Certificate:  Indian passports must be surrendered by foreign nationals at the Embassy to obtain the surrender certificate which may be submitted in original along with a copy of the same while applying for the OCI card.  After verifying the facts the original surrender certificate will be returned to the applicants. 
  5. For a person born abroad and applying on the basis of their parents/grand parents’ Indian origin - A copy of birth certificate/marriage certificate along with the Indian origin proof of their parents/grandparents must be furnished by the applicants to prove their link with them.
  6. Non-Indonesian passport holder should give residential Permit (KITAS) of Indonesia and such cases require more processing time.
Note: All original documents should be kept ready for verification at the time of submission of application.

The applicants desire to apply for Endorsement/Miscellaneous Services for PIO Cards viz. change of name, change of address, change of passport etc. have to apply for new OCI card.

How to Apply for OCI - Step by Step Guide

The Overseas Citizen of India application is in two parts, Part ‘A’ and Part ‘B’. Part ‘A’ MUST be filled on-line by the applicant

To start your online application:
1. On the Internet Logon to: https://passport.gov.in/oci/
    (Sometimes your Internet browser may say that website you are trying to access does not have security certificate, you can download the certificate or you have the choice to accept the same and go ahead to get to the OCI form.)

2. Select whether you are applying as an individual or family*
  • When you select the on-line registration form as “Family” option, the family on-line registration form will appear.
  • OCI Passport *Family Group option should be opted if only one of the parents is applying along with one/two minor children or husband & wife are applying otherwise you have to always opt an individual option. If there are more members in the family or children are not minor then their applications should be filed as individuals
3. Fill in the required information on the form. (Print a copy for your records)

4. Click the Submit button.
    In case of errors, a message will prompt you to fill in the required information. You can correct the information as required, review it for accuracy and submit the form again.

5. After you submit the form and there are no errors. A copy of the Part A will be displayed along with an online Registration Number. Print out this form.

6. Once you submit the application you will be able to download part B of the application form and print it out.

7. Print out both Forms A and B

8. Fill in the information required in Form B. This information can be hand-written in legible capital letters or typed. When filling Form B, if additional space is required, you can use additional sheets of paper.

9. Supporting documents are required to process your OCI application. Collect all the required documents and make copies of them. A list of documents required is given at the end of this chapter and is also printed at the end of Form ‘B’

10.Once you have completed Part A and B and collected all the required documents, they should be sent to the appropriate office where you are applying. This would be the Indian consulate office serving your area of residence if you are applying from abroad. The same one you selected on your online form under 'Place of submission'Application has to be submitted in duplicate for each applicant.

Documents Required with OCI Application 

1. Proof of present citizenship

2. Evidence of self or parents or grandparents,
•Being eligible to become a citizen of India at the time of Commencement of the Constitution; or
•Belonging to a territory that became a part of India after 15th August, 1947; or
•Being a citizen of India on or after 26th January, 1950
  These could be:
  •Copy of the passport: or
  •Copy of the domicile certificate issued by the Competent Authority; or
  •Evidence of relationship as parent/grandparent, if their Indian Origin is claimed as basis for grant of OCI.*
  •Any other proof that is acceptable to the authorities as proof of them being of Indian origin**.

*If parents’/grand parents’ origin is being claimed as basis for grant of OCI, the following documents are required:
 •Those who are claiming OCI card on the basis of parent’s Indian origin, their birth certificate showing their parents name is required. If you are claiming Indian origin based on your grandparents origin, then you have to submit your birth certificate as well as your parents’ birth certificate showing the parents’ names clearly so that it establishes the relation with your parents and grandparents.

 •Copy of their Indian passport, or

 •Copy of their domicile certificate issue by the competent authority; or any other documentary evidence like a notarized copy of school certificate, land ownership certificate by which eligibility can be logically established. Whether to accept the proof submitted or not would depend on the Consular Officer.

**Acceptable documents under “Any other proof” for evidence of self or parents or grandparents being eligible for grant of an OCI?When it comes to accepting other types of proof as supporting documents, the final decision to accept any type of documentary proof would rest with the consular officers. Some such documents may be:
 •Documentary evidence like a school certificate.
 •Land ownership records in India.
 •Birth certificate.
 •Any other type of documentation whereby eligibility may be reasonably ascertained to the satisfaction of the consulate officer dealing with your application.

Surrender Certificate Required
Former Indian Nationals, who apply for OCI, are also required to provide a ‘Surrender Certificate’ to show they Renounced their Indian Citizenship when they acquired foreign citizenship.

Photographs
One of the reasons for delay of processing OCI applications is the rejection of the photographs that are sent in by applicants as they do not meet the acceptable format set by the authorities. Care should be taken that the photographs you are sending meet the required guidelines.

Mail in OCI Application
Mail your form and documents by Registered Mail or Speed Post. Sending by Courier is discouraged by the authorities. As rules and regulations do change from time to time, read instructions on your form before mailing out your documentation. Form ‘B’ provides a complete list of documentation required to support your application.Make sure all documentation is included so as to avoid unnecessary delay to process your application.

What is OCI

An Overseas Citizen of India is a lifetime visa status. It is the closest thing to dual citizenship that India offers.

Who can be an OCI?

(This list was expanded as of 9 January 2015)
  1. A person who used to be an Indian citizen
  2. A person with at least one parent, grandparent, or great-grandparent who is/was an Indian citizen
  3. A person married to an Indian citizen or an existing OCI for at least two continuous years
The following groups of people can not have OCI status:
  • Anyone who was ever a citizen of Pakistan or Bangladesh
  • Anyone whose parents or grandparents were citizens of Afghanistan, Pakistan, Bangladesh, China, or Sri Lanka
  • Anyone who served in a foreign military or worked in a foreign defense department

What are the benefits of being an OCI?

  • Lifelong multiple entry visa to India
  • You never have to report to the FRRO regardless of the length of your stay
  • You can eventually become a citizen of India if you remain an OCI for 5 years and live in India for at least 1 year (short breaks are now allowed)
  • You can use special counters during immigration
  • You don’t need a student visa to study in India
  • You don’t need an employment visa to get a job
  • You can open a special bank account in India, just like an NRI
  • You can make investments in India
  • You can buy non-farm property and exercise property ownership rights
  • Your can use your OCI card to apply for a driver’s license, open a bank account, or get a PAN card
  • You get the same economic, financial, and education benefits as NRIs (e.g. reserved admission quotas), and you can adopt children like an NRI
  • You pay the Indian resident fee when visiting a national parks, monuments, museums or wildlife sanctuary (of course it is ultimately up to the discretion of the man issuing tickets)

What are the drawbacks?

  • You may not purchase agricultural land or farm houses
  • You may not vote
  • You may not hold a government job
  • You may not be elected to a political position
  • You may not travel to restricted areas without permission

How do you become an OCI?

You can apply through the Indian embassy in your country of residence or within India at the local FRRO.
Here is a sample of documentation you will need (see your local consulate for a specific list):
  • Proof of present citizenship
  • Proof of former Indian citizenship (for you or your relative)
  • Proof of renunciation of Indian citizenship (if applicable)
  • Proof of relationship to an Indian citizen
The entire process can take several months in some cases. Fees vary from nationality to nationality. If you apply in India, the fee is Rs. 15,000 for an adult or Rs. 8,000 for a minor. You can convert a PIO card to an OCI card if you qualify, and the fees are very nominal.

Informasi tambahan tentang PIO / OCI yang kami terima:

1. Selain peraturan PIO yang di tarik oleh pemerintah India, untuk yang sudah memegang PIO statusnya dianggap sama dengan pemegang OCI, yaitu lifetime visa holder. Bedanya kalau OCI selain card, mereka dapat "U visa" stiker di pasport ketika apply.

2. It is not necessary harus endors atau update PIO setiap ganti pasport. Bila traveling ke India, tinggal bawa saja PIO card, pp baru dan pp lama yang terdaftar dlm PIO. Kecuali untuk anak dibawah 20 tahun harus re-issued (OCI) setiap kali ganti pasport. 


3. Pendaftaran PIO ditutup dan dialihkan ke OCI.


4. Untuk PIO yg belum dapat lifelong stamp sebaiknya segera update PIO nya.


5. Pemegang PIO tidak harus convert PIO ke OCI karena statusnya sdh disamakan. Tetapi bila tetap ingin convert ke OCI dipersilahkan. Biayanya kalau di Jakarta Rp 280.000. Kalau di kedutaan di negara lain kurang lebihnya segitu.


6. Untuk pemegang OCI, setiap kali traveling ke India harus membawa pp yang terdapat stiker "U visa", OCI card dan pp baru (bila ganti pp). Sama seperti PIO card holder, tidak perlu endors/ update OCI tiap ganti PP kecuali yang dibawah umur 20tahun. Tetapi bila mau update dipersilahkan.

7. Apabila pemegang OCI travel ke India hanya membawa OCI card tanpa pp lama yang terdapat "U visa" stiker, akan diberikan ijin tinggal sementara oleh FRRO selama 30 hari dan bisa diperpanjang sampai dengan 180 hari. Tetapi bila membawa pp lama dengan "U visa" stiker tanpa oci card, masih diperbolehkan. 


Tetapi sebaiknya jangan sampai lupa semua dokumen penting selama perjalanan ya. Kita tidak tahu kapan nasib berpihak kepada kita kan

8. Oh ya...untuk OCI peraturan untuk spouse harus sdh menikah minimal 2 tahun.


9. Update PIO atau OCI diharuskan bila ada perubahan data pribadi, ada kesalahan data ketika apply atau kesalahan dr pihak embassy, hilang, ganti alamat.
